- General Provision


Lalamove is a third-party matching-service platform, which shall be referred to as “Lalamove”. Lalamove Delivery Partners are partners who have been trained and certified by Lalamove, and shall be referred to as “Lalamove Delivery Partners”.


This partnership agreement is for Lalamove users to participate in their free wills, and to have agreed to comply with, as well as having been acknowledged and committed to, as the purposes of the partnership agreement are outlined as follows:


  1. Maintain the trust of all parties involved in Lalamove
  2. Optimize interests of all parties involved in Lalamove
  3. Service protocols set up to effectively protect Lalamove Delivery Partners

Service Commitments

Commitment to Trustworthiness


Since Lalamove is a share-economy platform of which the collective interest is based on the trust and help offered amongst those involved Lalamove service, therefore Lalamove Delivery Partners must commit to maintain the fundamental trustworthiness of Lalamove service, which is never lie, never out of contact, never lack of integrity, never steal, never threaten, never harass, never curse, and never violate others’ rights, while creating a shared environment of mutual trust and help.



Commitment to Professionalism


Be sure to extend due courtesy to users, timeliness, conscientiousness, proactive attitude, kind politeness, always in touch, and avoid confrontation with users, or any violent behaviors, in keeping with the established premium service quality common to all Lalamove Delivery Partners.


Commitment to Agreement Fulfillment


After receiving orders, immediately commit to fulfill order requests or communication and coordination with users with timeliness, as well as charging the regulated fees stated in orders.


Commitment to Collaboration


Be willing to accommodate differences and shortcoming in thoughts, behaviors and stands of Lalamove, Lalamove Delivery Partners and users, with mutual assistance and acceptance in creating a better and inclusive shared collaborative environment.


Lalamove Delivery Partners shall be the sole party in bearing any legal, safety, loss or compensation related liabilities or risks, and so as to ensure personal safety, Lalamove Delivery Partners shall genuinely commit to fulfill all due obligations.


Circumstances deemed Violations of the Partnership Agreement


Major Partnership Agreement violations, as outlined below, will result in indefinite suspension of partnership status and rights by Lalamove.


1 Prohibit Lalamove Delivery Partners privately forming agreements with, or providing services to, users without the knowledge of, and approval by, Lalamove.


2 Prohibit charging additional fees outside Lalamove service charges.

Any additional charges such as parking fees and over-load fees, etc., which are not part of the Lalamove service charges, as well as charging waiting fees or cancellation fees nor according to Lalamove reporting procedure, are all deemed as violation to the Partnership Agreement


3 Prohibit the usage of any unregistered vehicles or identities to carry out Lalamove services.


4 Prohibit acceptance and undertaking of services that purely transports people, neither live or dead animals, or any illegal objects such as guns, drugs, ammunitions, and explosives, etc.


5 Prohibit any behaviors of deceit, theft, harassment, threat, and violence, etc., which compromise trust towards Lalamove, or Lalamove reputation, towards users, Lalamove Delivery Partners or Lalamove staffs.

6 Prohibit actions of breaching order integrity, or status of out-of-contact

Any lack of notification beyond the time of item pick-up is also deemed as breaching order or out-of-contact.

7 Prohibit the disclosure and leakage, or used for any non-order-request related purposes, of any confidential personal information obtained through Lalamove. For any general violation instance, in breach of the following restrictions, the first violation shall result in the agreement-breaching penalty of NT$100; the second violation shall result in the agreement-breaching penalty of NT$100 with Lalamove Delivery Partners status suspended until the completion of Lalamove Delivery Partners Orientation Training; the third violation shall result in the indefinite suspension of Lalamove Delivery Partners status and rights.


1)Failure to contact user within one minute after receiving order.


# Solid confirmation of item pick-up location, the consistency between service content and order information, in addition to inquiry on user acceptance of the feasible arrival-time so as to avoid disputes and risks.


# For the circumstances of lack of contact with users by newly-recruited Lalamove Delivery Partners resulting in the unnecessary trip made by other Lalamove Delivery Partners, the regulation calls for the newly-recruited Lalamove Delivery Partners to pay for the cost incurred by the resulted unnecessary trip.

2) Failure to contact the receiving parties prior to Lalamove Delivery Partners departure, to solidly confirm available time and location of the receiving parties.
# The risk of disputes, deceit, waiting or unnecessary trips, shall be borne by the perpetrating Lalamove Delivery Partners alone.


3) Failure to arrive at item pick-up location prior to the arrival time stated on the accepted orders; for “Deliver Now” orders not displaying order time, Lalamove Delivery Partners shall head towards pick-up location immediately after receiving orders, within which Lalamove Delivery Partners shall arrive at item pick-up locations, and any receiving or delivering of other orders throughout the item pick-up journeys.

 

4) Failure to cancel “Scheduled” orders 60 minutes prior to receiving orders, or to cancel “Deliver Now” orders due to personal circumstances of Lalamove Delivery Partners.

5) Failure to notify users and Lalamove Customer Service, in the case of cancelled orders.

6) Failure to provide services according to order requests, or to carry any accessories for special requests, Lalamove Delivery Partners rights shall be revoked.

7)Lalamove Motorcyclist Drivers/Partners


Failure to deliver to order destination within 30 minutes after item pick-up, for orders of total mileage-based amount of (NT$ 75 – NT$ 95);


Failure to deliver to order destination within 45 minutes after item pick-up, for orders of total mileage-based amount of (NT$ 110 – NT$ 200);


An increase of 15 minutes of allowed delivery time after item pick-up, as every increase of NT$75 in total mileage-based amount from NT$ 215 onwards, hence deducing the latest delivery arrival time allowed, with examples as follows:


Failure to deliver to order destination within 60 minutes after item pick-up, for orders of total mileage-based amount of (NT$ 215 – NT$ 275);

Failure to deliver to order destination within 75 minutes after item pick-up, for orders of total mileage-based amount of (NT$ 290 – NT$ 350);


8 Half-Car order for Lalamove Van Drivers/Partners


Failure to deliver to order destination within 1 hour after item pick-up, for orders of total mileage-based amount of (NT$ 165 – NT$ 347);

Failure to deliver to order destination within 2 hours after item pick-up, for orders of total mileage-based amount of (NT$ 369 – NT$ 567);


Failure to deliver to order destination within 3 hours after item pick-up, for orders of total mileage-based amount of (NT$ 592 – NT$ 1010);


Failure to deliver to order destination within 4 hours after item pick-up, for orders of total mileage-based amount of (NT$ 1032 or more); with extra 20-minute delivery time granted for every added intermediate stop added.


9 Full-Car order for Lalamove Van Drivers/Partners


Failure to deliver to order destination within 1 hour after item pick-up, for orders of total mileage-based amount of (NT$ 450 – NT$ 590);


Failure to deliver to order destination within 2 hours after item pick-up, for orders of total mileage-based amount of (NT$ 610 – NT$ 770);


Failure to deliver to order destination within 3 hours after item pick-up, for orders of total mileage-based amount of (NT$ 795 – NT$ 1650);

Failure to deliver to order destination within 4 hours after item pick-up, for orders of total mileage-based amount of (NT$ 1695 or more); with extra 20-minute delivery time granted for every added intermediate stop added.


10 Lalamove 1.75-ton Van Drivers/Partners


Failure to deliver to order destination within 2 hours after item pick-up, for orders of total mileage-based amount of (NT$ 500 – NT$ 965);


Failure to deliver to order destination within 3 hours after item pick-up, for orders of total mileage-based amount of (NT$ 995 – NT$ 2040);


Failure to deliver to order destination within 4 hours after item pick-up, for orders of total mileage-based amount of (NT$ 2095 or more); with extra 30-minute delivery time granted for every added intermediate stop added.


# Failure to raise relevant proof regarding special circumstances, prior to partnership agreement violation or reporting to Lalamove Customer Service as the special circumstances occur, shall be regarded as violation of partnership agreement violation.


# In any circumstance resembling that of partnership agreement violation, Lalamove Customer Service will, as top priority, send text messages to notify and assist raising complaint, and if having received no feedback from Lalamove Delivery Partners prior to the deadline of raising complaints, it shall be, as top priority, deemed as violation of partnership agreement, until any clarification, therefore, Lalamove Delivery Partners shall try their best to assist in investigation, and to expedite clarification.


Process Flow of Disciplinary Actions


If any raised complaint relating to a case of violation of Partnership Agreement is deemed as accurate, whether by customer complaint or not, Lalamove reserves the right to implement disciplinary actions. In the case of serious violation of Partnership Agreement, Lalamove also reserves the right to directly terminate partnership status and rights.


In the case of 1 accumulated violation, the name of the perpetrating Lalamove Driver/Partner shall be marked with “X” which can only be eliminated by request, after completion of 30 complain-free order deliveries.


In the case of 2 accumulated violations, the name of the perpetrating Lalamove Driver/Partner shall be marked with “XX” which can only be eliminated by request, after completion of 90 complaint-free order deliveries.


If any case of violation of Partnership Agreement perpetrated by Lalamove Star Delivery Driver is deemed as accurate, the status and rights of Lalamove Star Delivery Partner in question shall be revoked at monthly review.


All newly-activated Lalamove Delivery Partners must consecutively complete 20 orders without violating any part of the Partnership Agreement, and the failure to do so will lead to compulsory attendance of re-education training.


#The dollar amount of agreement-breaching penalty due to violation of partnership agreement shall be automatically deducted by Lalamove system, with any shortage of payable penalty payment shall be paid in full by cash at Lalamove headquarter, until such time Lalamove reserves the right of refusal to refund deposit or deposited credit.


#If non-violation of partnership agreement is proven to be accurate, Lalamove Customer Service shall assist in refunding the deducted agreement-breaching penalty amount. Lalamove Delivery Partners shall provide service according to the regulation service flow, and give feedback on the day of service, so as to enable Lalamove Customer Service in assisting to preserve the due rights of all Lalamove Delivery Partners.

 

Lalamove is a third-party matching-service platform. All orders or requests on Lalamove shall be deemed as personal behaviors of users, as for any legal, safety, loss or compensation problems caused by personal behaviors of Lalamove Delivery Partners, Lalamove Delivery Partners shall be the sole party bearing all related liabilities and risks, they can contact Lalamove Customer Service Hotline, as Lalamove preserves the right. Lalamove reserves the rights of final decisions and amendments of this Partnership Agreement.


Service Details


Loading Space

Prior to the acceptance of orders all vehicle types, the to-be-accepted orders shall be confirmed that the following minimum loading space is satisfied:

  1.  Orders for motorcycles:

40 × 40 × 40 公分

Total weight of a single order: 20 kg.

Total size of a single order: 30 x 60 x 40 cm

# Should order contains special requirement of “Lalabags”, the total size of space required additionally to accommodate for Lalabag : 40 x 40 x 40 cm.


  1. Orders for Vans (Half-Car):

Total weight of a single order: 200 kg (with a single item weighing less than 20 kg.)Total size of a single order: 100 x 100 x 100 cm.


  1. Orders for Vans (Full-Car):

Total weight of a single order: 300 kg (with a single item weighing less than 20 kg.) Total size of a single order: 150 x 100 x 100 cm


4Order for 1.75 (ton) trucks:


Total weight of a single order: 500 kg (with a single item weighing less than 20 kg.)Total size of a single order: 200 x 120 x 120 cm


Preparation prior to departure for work


Preparation of Appearance


Prior to performing services, Lalamove Delivery Partners shall maintain pleasant mood, professional attitude and neat dress etiquette so as to ensure service quality and image.



Software Preparation

Prior to receiving orders, Lalamove Delivery Partners shall make sure their mobile phones function properly in call reception, and for the sake of safeguarding their own interests, call-recording APP shall be properly installed, while maintaining GPS activated throughout services. As the built-in navigation feature in Lalamove software is only for reference purpose, so as to ensure streamlined service quality, please install professional navigation system on mobile devices.


Hardware Preparation


Prior to receiving orders, Lalamove Delivery Partners need to ensure the proper functioning of their vehicles and mobile phones, and prepare order request content and accessories such as Lalabags, while carrying sufficient changes. Lalamove Delivery Partners of vehicle types other than motorcycle shall be self-equipped with trolley and gloves for their own operations.


Thorough Read-Through of Orders


Prior to accepting orders, order details such as all delivery-critical times (, location, remarks and special delivery-related requests, etc., shall be read through thoroughly, before confirming order acceptance, hence indicating the willingness to bear responsibility for the to-be-accepted orders.

Contact for Receiving Orders

Immediate Notification

Within one minute after orders are confirmed, Lalamove Delivery Partners shall contact users by phone to confirm order information to avoid disputes and risks.


Confirmation of Information

When contacting users, Lalamove identity shall be communicated to users directly, before confirming item pick-up location, the consistency between service content and order information, and also inquiring customer acceptance of the feasible delivery arrival time so as to avoid disputes and risks.


Timeliness of Item Pick-Up


Lalamove Delivery Partners shall arrive on time, within the item pick-up time stated on orders or agreed upon with users, so as to ensure the sustainability of mutual trust.


Confirmation on Item Pick-Up


During item pick-up, Lalamove Delivery Partners shall confirm with users whether delivery items are complete, as well as the amount of service charge, before pressing “Picked Up” after completing item pick-up, so as to ensure their own interests.


Delivery Contact & Delivery Notification


Confirmation of Information


When contacting users, Lalamove identity shall be communicated to users directly, before confirming item pick-up location, the consistency between service content and order information, and also inquiring customer acceptance of the feasible delivery arrival time so as to avoid disputes and risks.


Confirmation on Item Delivery


During item delivery, Lalamove Delivery Partners shall ensure the receiving of delivery payment, before handing over the delivery items to the receiving party, before pressing  delivery “ Completed ” ! after completing item delivery, so as to ensure their own interests.


Procedure of Cancellation


Apart from special or unforeseeable circumstances, order cancellation or no-show, without reasons, are prohibited. If the need to cancel orders ever arises, Lalamove Delivery Partners shall first notify users directly, as well as contacting Lalamove Customer Service by phone for assistance. “Scheduled” orders shall be notified 60 minutes prior to the pick-up time stated on the accepted order.


# Should frequent cancellations by Lalamove Delivery Partners do occur, Lalamove system will automatically suspend their order-acceptance authorizations to receive orders for adjustable time-period based on the actual committed frequency of cancellations.


Actual Record

Software Record


Services shall be carried out after orders are received, before press the corresponding button to record time so as to safeguard their own interest. If unable to complete the ordered delivery on the day, and not notifying Lalamove Customer Service any special circumstance for the incomplete delivery, Lalamove system will automatically and temporarily suspend the right of the perpetrating Lalamove Delivery Partners to receive orders.  


Confirmation of Payment


Lalamove Delivery Partners should confirm method of receiving payment and the corresponding amount, and are prohibited to receive extra payment in private, therefore should Lalamove Delivery Partners have any queries, Lalamove Delivery Partners should actively seek immediate confirmation with users, or contact Lalamove Customer Service for guidance.


Rectification on the Day


Should there be any rectification to the amount of service charge, all Lalamove Delivery Partners are obligated to notify Lalamove Customer Service to process the rectification on the day, so as to avoid affecting accounting operation of the day, and consequently resulting in failure of making outstanding payment, or extra credit deduction from users’ accounts, and in the case of reporting rectification outside the business hour of Lalamove Customer Service, Lalamove Delivery Partners should email the rectified information to Lalamove Customer Service on the day, or report to Lalamove Customer Service through Lalamove Delivery Partners ‘ version of Lalamove Driver APP.


Lalamove Delivery Partners Rights and Interests


Lalamove Delivery Partners Protection Principle


1 In the case of lack of phone contact from Lalamove Delivery Partners prior to departure, there shall be no guarantee for seeking protection for Lalamove Delivery Partners’ rights and interests.

2 In the case of failure in providing service according to the agreed service requirement and content, or of violation of Partnership Agreement, , there shall be no guarantee for seeking protection for Lalamove Delivery Partners’ rights and interests.

Waiting Period


When carrying out item pick-up, Lalamove Delivery Partners motorcyclists shall wait for users up to at least 10 minutes, as Lalamove Delivery Partners of other vehicle types shall wait for users up to at least 20 minutes, and in the case of having to wait beyond the aforementioned waiting period durations, Lalamove Delivery Partners reserves the right to carry out the following actions:


  1. Refusal to keep on waiting, and report to Lalamove Customer Service to assist in increase additional charge of Cancellation Fee.

  1.  Reporting to Lalamove Customer Service to assist in confirming with users for the waiting fee incurred by the extra waiting-period


When carrying out item pick-up at intermediary locations or delivery destinations, Lalamove Delivery Partners motorcyclists shall wait for users up to at least 10 minutes, as Lalamove Delivery Partners of other vehicle types shall wait for users up to at least 20 minutes, and in the case of having to wait beyond the aforementioned waiting period durations, Lalamove Delivery Partners reserves the right to carry out the following actions:


  1. Refusal to keep on waiting, before returning the delivery item to the designated location, report to Lalamove Customer Service to assist in charging additional Cancellation Fee.

  1. Reporting to Lalamove Customer Service to assist in confirming with users for the waiting fee incurred by the extra waiting-period (Lalamove Delivery Partners motorcyclists is not entitled to waiting fees for stops at intermediary stops)

#  Please contact Lalamove Customer Service immediately, if users may cause extra waiting period for Lalamove Delivery Partners, as the waiting period shall be confirmed by Lalamove Customer Service as a third-party, before waiting period can start its time count, so as to ensure rights and interests of both parties, as well as benefiting the charging of additional fees.


# In the case of failure, on the part of Lalamove Delivery Partners, in contacting users by phone which lead to extra waiting period, there shall be no guarantee for seeking protection for Lalamove Delivery Partners’ rights and interests.


Extra-Time Waiting Fees


The Extra-Time Waiting Fee for Lalamove Delivery Partners motorcyclists may start time-count after reporting to Lalamove Customer Service for record.


For waiting period of less than 10 minutes, starting from the time of having reported to Lalamove Customer Service, the Extra-Time Waiting Fee is NT$0.


For waiting period of 11 ~ 40 minutes, starting from the time of having reported to Lalamove Customer Service, the Extra-Time Waiting Fee is NT$50.


For waiting period of 41 ~ 60 minutes, starting from the time of having reported to Lalamove Customer Service, the Extra-Time Waiting Fee is NT$100.


For waiting period of longer than 60 minutes, every additional 60 minutes on top of the first 60 minutes of extra-waiting period will result in an additional fee of NT$150, and so on and so forth.


For waiting period of 61 ~ 120 minutes, starting from the time of having reported to Lalamove Customer Service, the Extra-Time Waiting Fee is NT$250.


For waiting period of 121 ~ 180 minutes, starting from the time of having reported to Lalamove Customer Service, the Extra-Time Waiting Fee is NT$400.


The Extra-Time Waiting Fee for Lalamove Delivery Partners of other vehicle types may start time-count after reporting to Lalamove Customer Service for record, is NT$200 for every 30 minute of extra-time waiting period.


For waiting period of less than 20 minutes, starting from the time of having reported to Lalamove Customer Service, the Extra-Time Waiting Fee is NT$0.


For waiting period of 20 ~ 50 minutes, starting from the time of having reported to Lalamove Customer Service, the Extra-Time Waiting Fee is NT$100.


For waiting period of 50 ~ 80minutes, the Extra-Time Waiting Fee is NT$400, and so on and so forth.


#For scheduled orders, if Lalamove Delivery Partners report their arrival before the due arrival time, the free waiting time shall still start at the time of order being submitted.

Cancellation Fees

Inconsistency between Service Demanded and Orders Made


In the case of users not giving prior notice, as Lalamove Delivery Partners has arrived at the item pick-up location, before finding the actual service requirement not matching that of the order, Lalamove Delivery Partners reserve the right to cancel the order in question, and to be assisted by Lalamove Customer Service to charge cancellation fee, which is half of the starting price of the same vehicle type.


Impromptu Cancellation of Accepted Orders


In the case of users not giving prior notice, as Lalamove Delivery Partners has arrived at the item pick-up location, and users decided to cancel orders without giving any prior notice, Lalamove Delivery Partners reserve the right to contact Lalamove Customer Service for assistance to charge cancellation fee, which is half of the starting price of the same vehicle type.


Unable to Deliver to Destination


In the case of user-related factors leading to incomplete orders as Lalamove Delivery Partners have arrived at the delivery destination started on the orders, users are not eligible to demand refund, however, Lalamove Delivery Partners shall deliver the item(s) to other designated delivery destinations, and seek assistance from Lalamove Customer Service to charge any consequent additional fees incurred by extra distance travelled by Lalamove Delivery Partners.


Contraband Items

Lalamove Delivery Partners and Lalamove bear no responsibility for the fact of being unaware of the content of items of complete package, and all related legal and safety issues caused by the content of the item(s) in question.

If encountering any order with suspicious circumstances, Lalamove Delivery Partners shall directly refuse service, and report the incident to Lalamove Customer Service.

Guarantee to Compensation


In the case of incomplete packaging of the to-be-delivered items that may easily lead to item damages, Lalamove Delivery Partners reserves the right to demand users to complete the packaging in question, or the right to refuse to receive the to-be-delivered items.


If any Lalamove Delivery Partners, who agree to receive any to-be-delivered items with incomplete packaging, should notify users, prior to the acceptance of receiving the to-be-delivered item(s) in question that in the case of the delivery items are damaged, users shall be the sole party bearing responsibility for any damage caused, of which photos shall be taken to report to Lalamove Customer Service for establishing third-party record so as to ensure better safeguard of the rights of Lalamove Delivery Partners.


If any damage is deemed genuine after confirmation, Lalamove Delivery Partners shall compensate according to the proof of item value provided by users, but if Lalamove Delivery Partners did not violate Partnership Agreement in anyway, the maximum compensation amount is NT$500 for deliveries via motorcycle, and NT$20,000 for deliveries via other vehicles.


If any loss of delivery item(s) is deemed genuine after confirmation, Lalamove Delivery Partners shall compensate in the full amount stated in the proof of item value provided by users. If the aforementioned compensation was not carried out by Lalamove Delivery Partners two calendar days after receiving compensation notice from Lalamove, Lalamove reserves the right to deduct the compensation amount from TOP-Up credit and deposit of the Lalamove Delivery Partners involved in such incidents, whose Partnership status shall also be temporarily suspended.



Guarantee for Purchase-and-Pay


In order to safeguard the rights and interests of Lalamove Delivery Partners in the service of Purchase-and-Pay, for the orders of service charge amount, including “Payment by Cash”, the maximum amount of guarantee coverage for Purchase-and-Pay service is NT$2,000, and as for the service fee amount of Purchase-and-Pay service with “Paid-by-Lalamove” option selected, shall be fully covered by the corporate users involved, and before fully paid for by the aforementioned corporate users, the maximum amount of guarantee coverage for Purchase-and-Pay by Lalamove is NT$5,000.

  

When Lalamove Delivery Partners carry out the special service of “Purchase-and-Pay”, the following confirmations shall be made in obligation, as no guarantee can be entitled to by Lalamove Delivery Partners if any of the following confirmation was not made:


  1. Prior to service, contact by phone shall be made, so Lalamove Delivery Partners need to confirm that they are contactable by phone.

  1. For orders with “Paid-by-Cash” option, the amount for Purchase-and-Pay service does not exceed NT$2,000.
  2. No Purchase-and-Pay service is available for the delivery of items purchased online, such as item pick-up from convenience stores, purchase-and-pay from private residences, hotels and all other random locations without proper addresses, etc.

  1. If encountering any order with possible queries in question, Lalamove Delivery Partners should request confirmation by Lalamove Customer Service personnel before accepting the orders in question, and should refuse all orders with possible queries in question, received outside the business hour of Lalamove Customer Service.

5      When Lalamove Delivery Partners encounter fraud-related deliveries, they shall first contact Lalamove Customer Service while reporting such incidents to local police stations, before completing police interviews, and obtaining hardcopy of police report which shall be provided to Lalamove Customer Service ASAP.


Labor and Health Insurance

There is neither employment nor service relationships between Lalamove and Lalamove Delivery Partners, therefore, no labor and health insurance shall be provided, in accordance to relevant labor and health insurance regulations, if Lalamove Delivery Partners intend to have additional protection, they can apply to associated labor union organization, or call Lalamove Customer Service for consultation.


Lalamove Customer Service Assistance


If any Lalamove Delivery Partners encounter any order-related problems, please report to Lalamove via the built-in reporting function of Lalamove Delivery Partners’ APP, as Lalamove Staffs shall assist in processing the reported issues with all efforts and resources available. If reporting needs to take place outside the business hour of Lalamove Customer Service, related text messages regarding assistance required by Lalamove Delivery Partners must be left to Lalamove Customer Service which shall provide assistance during operating hours in the very next working day.


If encountering non-order-related problems, please make inquiries through Lalamove’s official Line@ account, as there will be specialists answering your queries according to their servicing periods.
