1.         はじめに

1.1      本プライバシーポリシーは、Lalamoveとその関連会社（以下「当社」及び「Lalamove」といいます。）が共にあなたの個人データを収集、保持、処理、移転及び利用する方法、並びにあなたが、個人データの処理に関し付随して有する権利について説明しています。本プライバシーポリシーの目的上、Lalamoveとは、あなたが本プライバシーポリシーを受け取る日に、あなたのために本サービスを提供する特定の企業をいいます（別紙2の全てのLalamove企業の表をご覧ください）。

 

1.2      本プライバシーポリシーは、あなたが当社のウェブアプリケーション、モバイルアプリケーション（以下、総称して「本アプリケーション」といいます。）及び当社のウェブサイト https://www.lalamove.com/ja-jp/を利用する際に、当社が収集する以下の個人データに関係するものです。

 

1.3      当社は、本アプリケーション及びウェブサイトを、当社のプラットフォームのユーザーと他の手段による運送を利用する個人を含むドライバーを結びつけるプラットフォームとして機能させ、当該ドライバーによるオンデマンド配達サービス及び購入サービス（以下「本サービス」といいます。）の提供を促進するために運営しています。当社の本アプリケーション及び本サービスは、主として成人を対象としています。当社は、個人データを未成年者（即ち、18歳又はこれに相当する当該国において完全な法的能力を有する最低年齢に達していない者）から、当該データが関係者（即ち、当該未成年者に対し親権者としての責任を有する者）の事前の承諾を得て提供された場合を除き、意図的に収集することはありません。あなたは、当社に対する親権者としての責任に基づき、関係者として未成年者の個人データを開示する場合、これにより当該未成年者の個人データの収集及び処理について承諾し、本プライバシーポリシーに拘束されることに承諾し同意しています。当社は、当該未成年者に対する親権者としての責任を有する者の承諾なく、未成年者から個人データを収集したことを知った場合、当該個人データを削除します。

 

1.4      本プライバシーポリシーは、以下の者（以下総称して「あなた」又は「あなたの」といいます。）の個人データに適用されます。

 

(A)       本ビジター：当社のウェブサイトを訪問する個人、又は以下に定義する本ユーザーではない本アプリケーションをダウンロード若しくはこれにアクセスする個人

(B)       本ユーザー：(i)本サービスを利用、要求、又は受領する個人、 (ii)当社のウェブサイト、本アプリケーションを通じて又は電話若しくはその他の通信手段により当社にコンタクトをする個人、(iii)当社のコンテスト若しくはコンペティションに参加する個人、又は (iv)当社の最新情報若しくはブログを購読する個人

(C)      本エージェント：当社の法人顧客の代表者又は車両保有会社の所有者、管理者、リーダー若しくはその他の代表者等のビジネスパートナー、及び

(D)      本ドライバー：当社の本アプリケーションを通じてご自身で若しくはパートナー企業を通じて、本サービスを提供するために当社に申込みを提供し若しくは提出する個人。ただし、Lalamoveにドライバーとしてその後問題なく登録されるか否かを問いません。

 

1.5      当社のウェブサイト、本サービス、又は本アプリケーションを利用される前に、本プライバシーポリシーをお読みになりご理解ください。

 

2.         個人データのデータ源

2.1      あなたが当社のウェブサイトを訪問し、当社の本アプリケーション及び本サービスにアクセスするか又はこれを利用する際、当社は、あなたの個人データを提供するようあなたに要求することがあります。あなたが該当するデータを提供しない場合、当社はあなたに当社の製品若しくはサービスを提供すること、又はあなたがし得る質問に回答することができない可能性があります。例えば、あなたは当社のウェブサイト又は本アプリケーションを通じて配達サービスを要求できない可能性等があります。

 

2.2      当社は、以下の個人データの収集及び処理をします。

 

(A)       当社の本アプリケーションを通じてアカウントを作成する、当社のコンペティション、コンテスト及び販売促進活動に参加する、当社のブログ若しくは最新版を購読する、又は当社のウェブサイト、本アプリケーションを通じて若しくは電話により当社と交信をする間等にあなたが直接当社に提供したデータ、

(B)       あなたが当社のウェブサイト、本サービス及び本アプリケーションを利用する間に生成されるデータ。例えば、当社は、あなたが当社のウェブサイトを訪問する際あなたのIPアドレス及びデバイス情報を収集することができます。

(C)      当社が第三者（第三者のエージェント、他の本ユーザー、当社のサービスプロバイダー及びビジネスパートナー等）から得たデータ。例えば、当社の第三者のエージェントは、本ドライバーの追加の確認情報及びバックグラウンド情報を当社に提供することができ、他の本ユーザーは、あなたのために車両を予約する際にあなたの名前及び電話番号を当社に提供する可能性があります。

 

2.3      当社は、本サービスを提供する際に使用されるソフトウェア開発キットを通じて個人データを収集する可能性もあります。

 

2.4      当社は、当社のドライバー紹介プログラム及びドライバーキャンペーン（以下「ドライバープログラム」といいます。）に参加する本ドライバーから、ドライバープログラムに登録又は参加する本ドライバーの要請の処理に関係する範囲内で、個人データを収集する可能性もあります。

 

3.         当社はあなたに関する個人データをどのように収集するでしょうか

3.1      当社があなたについて収集する個人データには、以下のデータが含まれます。

 

(A)       本ビジターから

(1)    IPアドレス又はその他の一意のデバイス識別子、及び

(2)    当社のウェブサイト又は本アプリケーションの利用

(B)       本ユーザーから

(1)    名前

(2)    電子メールアドレス

(3)    電話番号

(4)    住所

(5)    当社との交信

(6)    IPアドレス又はその他の一意のデバイス識別子

(7)    支払及び銀行の情報

(8)    ジオロケーション

(9)    ログイン情報、パスワード、 プロフィール画像、保存したルート、優先言語、好みのドライバー情報、フィードバック、格付け、賛辞、注文の詳細、利用したサービスの種類、本ユーザーが参加する紹介プログラムの紹介者及び被紹介者の情報を含む本ユーザーのプロフィール情報

(10) 本アプリケーションの利用又はその他の関連データ、及び

(11) 当社の本サービスを利用する際に本ユーザーがフリーテキストボックスに自発的に入力した個人データ。

(C)      本エージェントから

(1)    名前

(2)    電子メールアドレス

(3)    会社名

(4)    職務上の役職

(5)    電話番号

(6)    事業の業種

(7)    住所

(8)    当社との交信

(9)    IPアドレス又はその他の一意のデバイス識別子

(10) 支払及び銀行の情報

(11) ジオロケーション

(12) 本エージェントのプロフィール情報（プロフィール画像を含みます。）

(13) 本アプリケーションの利用又はその他の関連情報、及び

(14) IDカードの写し又はマイナンバー（個人番号）及び有効期限

(D)      本ドライバーから:

(1)    名前

(2)    電話番号

(3)    e電子メールアドレス

(4)    自宅住所

(5)    当社との交信

(6)    IPアドレス又はその他の一意のデバイス識別子

(7)    支払及び銀行の情報

(8)    ジオロケーション

(9)    ログイン情報、パスワード、 プロフィール画像、車両の写真、優先言語、フィードバック、格付け、賛辞、ドライバーが参加する紹介プログラムの紹介者及び被紹介者の情報を含む本ドライバーのプロフィール情報、

(10) 本アプリケーションの利用又はその他の関連情報、

(11) 運転免許証番号及び有効期限

(12) 料金の収集及び支払に必要となる情報

(13) 車両の情報及び写真

(14) 車両保険に関する情報

(15) 身分証明書のコピー、マイナンバー、有効期限、身分証明書の写真

(16) ドライバーの顔写真および照合時にドライバーから任意で提供された関連の顔認識データ

(17) 生年月日

 

3.2      当社は、本プライバシーポリシーの第4条に記載する目的に関連して利用に合理的に必要となる個人データのみを収集します。当社は、不要な又は必要以上の個人データを収集しません。

 

4.         当社はどのようにあなたの個人データを利用するでしょうか

4.1      当社は、以下の形式であなたの個人データを収集、処理、コンパイル及び照合する可能性があります。

 

(A)       本ビジター、本ユーザー、本エージェントについて

(1)    プロフィール情報の記録

(2)    カスタマーサービスとのやり取りの記録を含む、当社の本サービスの利用に関する見解、記録及び報告

(3)    当社の本サービスに関する支払の記録

(4)    バグレポート、コンペティション又はコンテスト及びログインセッションを含む当社の本アプリケーションの利用の記録及び報告

(5)    あなたのライブチャットの履歴並びに本ドライバーに対するフィードバック及び格付けの記録

(B)       本ドライバーについて

(1)    プロフィール情報の記録

(2)    カスタマーサービスとのやり取り、本ドライバーのオペレーション、フィールドエージェント、第三者サービスプロバイダーの記録を含む当社の本サービスの利用の記録及び報告

(3)    当社の本サービスに関する支払の記録

(4)    バグレポート、コンペティション又はコンテスト及びログインセッションを含む当社の本アプリケーションの利用の記録及び報告

(5)    ライブチャットの履歴並びに本ユーザー及び本エージェントからのフィードバックの記録

(6)    あなたの配達及びパフォーマンスの記録、及び

(7)    あなたの車両、運転免許証、車両保険及び車検証並びに運送業を行うための登録又は許可の記録

 

4.2      当社は、あなたの個人データを以下の目的のために処理することができます。

 

(A)       本ビジター、本ユーザー及び本エージェント

(1)    当社の本サービスを以下の目的等のために提供及び維持するため

(a)    あなたが当社に登録したアカウントを作成、更新及び維持する目的、

(b)    運送及び配達を可能にする目的

(c)    配達を追跡する目的、及び

(d)    配達又は当社の本サービスに対する支払を提示、処理又は促進する目的。

(2)    当社のウェブサイト、本サービス又は本アプリケーションの利用を精査するため

(3)    当社の本サービスの安全性、セキュリティ及び整合性の維持を促進し、犯罪及び詐欺を防止するため

(4)    当社の本アプリケーションに関するあなたの体験を最適化するため：あなたの好み及び行動を明らかにすることで、当社があなたの個人的なニーズ及び興味をより理解し、より適した本サービスをあなたに提供するのを促進します。当社は、このマーケティング活動のうちいくつかについては、あなたの承諾を要求する場合があります。承諾を要する場合には、当社があなたの承諾を得た場合のみ、当社はマーケティング活動を行います。あなたは、当該情報の受信を希望しない場合、いつでも配信停止を選択することができます。

(5)    当社のウェブサイト、本サービス及び本アプリケーションを改良するため、又は新しいものを開発するため：当社は、新しい仕様及び機能を開発するため、当社のソフトウェア及びインターフェースデザインを改良するために、あなたの個人データを利用することができ、セキュリティの仕様を改善するためにエラーレポートを使用することができます。

(6)    カスタマーサービスのため：あなたの個人データは、あなたのカスタマーサービスに対するリクエストへの対応、フィードバックの受領及びニーズに対するサポートを当社がより効果的に行うのに役立ちます。

(7)    研究及び開発のため：あなたの個人データは、当社の体験を改善するために当社がテスト、研究、分析、製品開発及び機械学習の支援をするのに役立ちます。

(8)    あなたに関する総統計を蓄積するため、及びあなたの本サービス及び本アプリケーションの利用を分析するため

(9)   当社の本アプリケーション又は本サービスの変更に関する通知等の当社の本サービスに関連するマーケティングの対象外のコミュニケーションのため

(10) 当社の事業を管理するため：当社は、あなたの個人データを当社の事業の経営及び管理（個人データを保存するデータベースの管理及び維持を含みます）のために使用することができます。

(11) 法令上の手続又は規制当局、政府機関及び公的な調査による要求に従うため、又は当社の法令上の義務を遵守するため、及び

(12) 適用される法令に従い、かつ本プライバシーポリシーの第14条に規定するとおりに、あなたの承諾を取得したことを条件とする、ダイレクトマーケティングのため。

 

(B)       本ドライバー

(1)    以下のような目的のために、当社の本サービスを提供し維持するため

(a)    当社に登録するあなたのアカウントを作成、更新及び維持する目的

(b)    運送、注文及び配達を可能にし、通知する目的

(c)    配達を追跡する目的、及び

(d)    配達又は当社の本サービスに対する支払を提示、処理又は促進する目的。

(2)    当社の本サービス又は本アプリケーション及びウェブサイトの利用を精査するため

(3)    当社の本サービスの安全性、セキュリティ及び整合性の維持、並びに本ドライバーのスクリーニング等、犯罪及び詐欺の防止を促進するため

(4) 当社は、ドライバーのアカウントや身元、安全を保護するために、身分証明書の写真、プロフィール写真、および本人から提出された写真を使用することがあります。地域によっては、ドライバーのアカウントへの不正または違法なアクセスを防止するために、顔認識技術を使用することもあります。

(5)    当社の本アプリケーションに関するあなたの体験を最適化するため：あなたの好み及び行動を明らかにすることで、当社があなたの個人的なニーズ及び興味をより理解し、より適した本サービスをあなたに提供するのを促進します。当社は、このマーケティング活動のうちいくつかについてはあなたの承諾を得る可能性があります。承諾を要する場合には、当社があなたの承諾を得た場合のみ、当社はマーケティング活動を行います。あなたは、当該情報の受領を希望しない場合、いつでも配信停止を選択することができます。

(6)    当社のウェブサイト、本サービス及び本アプリケーションを改良するため又は新しいものを開発するため：当社は、新しい仕様及び機能を開発するため、当社のソフトウェア及びインターフェースデザインを改良するためにあなたの個人データを利用することができ、当社はセキュリティの仕様を改善するためにエラーレポートを使用することができます。

(7)    カスタマーサービスのため：あなたの個人データは、あなたのカスタマーサービスに対するリクエストへの対応、フィードバックの受領及びニーズに対するサポートを当社がより効果的に行うのに役立ちます。

(8)    研究及び開発のため：あなたの個人データは、当社の体験を改善するために当社がテスト、研究、分析、製品開発及び機械学習の支援をするのに役立ちます。

(9)    本ドライバーが提供するサービスのパフォーマンス指標を含む、あなたに関する総統計を蓄積しあなたの本サービス及び本アプリケーションの利用及び配達を分析するため

(10)    当社の本アプリケーション又は本サービスの変更に関する通知等当社の本サービスに関連するマーケティングの対象外のコミュニケーションのため

(11) 当社の事業を管理するため：当社は、あなたの個人データを当社の事業の経営及び管理（個人データを保存するデータベースの管理及び維持を含みます）のために使用することができます。

(12) 法令上の手続又は規制当局、政府機関及び公的な調査による要求に従うため、又は当社の法令上の義務を遵守するため

(13) 適用される法令に従い、かつ本プライバシーポリシーの第14条に規定するとおりに、あなたの承諾を取得したことを条件とする、ダイレクトマーケティングのため、及び

(14) 保険の購入を含む本ドライバーに対する便益の提供のため

 

4.3      当社は、本プライバシーポリシーでカバーされない他の目的のために、あなたの個人データを利用することを望む場合、あなたに知らせ、該当する場合はあなたの事前の承諾を取得し、あなたの個人データの利用が適用される法令を遵守することを確保します。

 

4.4      当社は、以下の１つ又は複数に該当することを理由に、あなたの個人データをこの方法で利用することが許されています。

 

(A)       当社があなたの承諾を取得したこと

(B)       あなたに対する当社の契約上の義務を履行するために必要であること

(C)      当社が履行する必要のある法令上の義務及び規制上の義務を有すること

(D)      あなたの個人データの記載された通りの利用が当社の法令上の利益のために必要であること

(E)       公衆衛生上の事象に対応するため又は自然人の重大利益を保護するために当社がそうする必要があること、又は

(F)       あなたの個人データを処理することについて、適用される法令に許容される他の法令上の根拠があること。

 

4.5      全てのデータ保護法は同じではないため、第4.4条に掲げる法的根拠の全てが全ての国で適用されるわけではありません（例えば、法令上の利益が、ある国においては許容される法的根拠にはなりません）。当社は、あなたの個人データを、あなたの国において適用される法令により許容される法的根拠に従い処理します。

 

4.6      当社が収集したあなたの個人データは、当社が事前にあなたの承諾を得た場合又は適用される法令に許容されるその他の法的根拠に基づく場合を除き、第三者に、彼ら自身のダイレクトマーケティングの目的で、売却、交換、共有、移転又は付与されることはありません。

 

5.         個人データの共有及び開示

5.1      当社の本サービスは、当社があなたの個人データを他のユーザーと共有することを必要とします。これには、以下が含まれます。

 

(A)       本ユーザーが自主的に記入したフリーテキストボックスに含まれる本ユーザー又は本エージェントの氏名、電話番号、個人データ、並びに配達を完了する目的で配達が開始された後の本ドライバーの集荷又は引渡場所の共有

(B)       本ドライバーの名前、電話番号、ドライバーのプロフィール情報、車両情報、車両の写真及び配達を完了する目的で配達が開始された後の本ユーザー又は本エージェントのジオロケーションの共有、並びにあなたが、あなたの個人データを本ドライバー、本ユーザー又は本エージェントに開示する際には、注意すべきです。あなたが個人データを共有することを選択し得る他のユーザーの行為を当社は規制できないことを、あなたは理解し確認します。当社は、当該機能の利用を通常の業務において精査しませんが、これを当社の裁量で行う権利を留保します。そのため、あなたは、他のユーザーと共有する個人データが権限のない者に閲覧されないことを、当社が保証することができずかつこれを保証しないことを理解し確認します。また、あなたは、あなたの個人データは、配達が完了した後にあなたが個人データを共有した当該ユーザーによってアクセスされる可能性があることを確認します。例えば、当該ユーザーは、あなたの個人データを含む取引記録を閲覧する可能性があります。

 

5.2      当社は、あなたの個人データを当社のウェブサイト、本サービス、本アプリケーションを提供するために又は法令上の理由で以下の者と共有する可能性もあります。

(A)       当社の従業員、役員又は独立のコンサルタント

(B)       当社の監査人、外部の法律顧問及び財務アドバイザー

(C)      以下を含む当社のサプライヤー、ビジネスパートナー、データ処理者、下請業者

(1)    ITサービス及びソフトウェアのサプライヤー

(2)    支払処理業者及びペイメントファシリテーター

(3)    クラウド型プラットフォームサービスプロバイダー

(4)    クラウドストレージプロバイダー

(5)    データ分析プロバイダー

(6)    リサーチパートナー

(7)    当社の広告及び販売促進を制作するマーケティング及び広告の代理店

(8)    バックグラウンドチェック及び本人確認を行う業者

(9)    当社のウェブサイト及び本アプリケーションの安全性及びセキュリティを確保するために当社を補助するベンダー、及び

(10) カスタマーサービスの提供業者

(D)      当社の保険会社、銀行及び本ドライバーの保険会社

(E)       当社が適用される法令の要件に基づき開示する義務を負担する又は別途開示を要求される規制当局又は政府機関

(F)       当社の関係会社 ：当社は個人データを、当社の子会社及び親会社並びに当社のために当社の本サービスの提供又はデータ処理の実施を促進するその他の関係会社と共有します。

(G)      当社が適用される法令、法令上のプロセス、政府の要請により要求されていると信じる場合、又は開示が安全上の懸念から適切である場合に、該当する者。これには、あなたの個人データを、犯罪／詐欺の防止及び予防目的で他の企業又は組織と交換することも含まれます。又は

(H)      合併、会社資産の売却、企業統合、組織再編、当社の事業の全て又は一部に関する他の会社による又は他の会社への資金供給又は買収の交渉に関連する又はその過程にある別の企業.

 

5.3      当社は、本プライバシーポリシーの第5.2条に規定する第三者とあなたの個人情報を共有する前に、第三者が守秘義務を負うことを確保します。

 

5.4      当社は、本プライバシーポリシーの第5.2条に記載する場合以外にも、いずれかの者とあなたの個人データを共有する可能性があります。当該状況においては、当社は、あなたに通知をし、適用される法令により必要とされる場合は事前にあなたの承諾を得ます。

 

5.5      当社は、あなたの個人データを第三者に売却せず、法令上許容される範囲内でのみ、個人データを適法かつ公正に利用することを保証します。

 

6.         個人データの海外移転

6.1      当社は、世界中で事業を行っており、世界中で当社のオペレーションを展開しています。その結果、当社は個人データを世界規模で収集し移転します。これは、当社があなたの個人データをあなたの国／地域以外の場所に移転する可能性があることを意味します。当社は、あなたの個人データのこのような移転が、本プライバシーポリシーに従い、適用される法令を遵守することを確保します。例えば、適用される法令により要請される場合、当社は、あなたの国／地域以外の場所に移転される個人データが適用される法令に基づく基準に相当する基準で保護されること、並びに、当社は適用される法令により要請される場合、あなたの個人データの国外の受領者から同様の誓約を獲得することを確保します。

 

6.2      より詳細な情報については、以下の「当社への連絡」の項に記載する詳細をご利用の上、当社にご連絡下さい。

 

7.         個人データのセキュリティ

7.1      当社は、あなたの個人データを受領する場合、あなたの個人データが安全に保存され、当社及び当社のデータ処理者により無権限の又は予期せぬアクセス、処理、削除、損失又は利用から保護されるよう、適用される法令に基づき必要とされる実務上合理的な全ての措置及びセキュリティ対策を利用します。

 

7.2      あなたの個人情報は、本プライバシーポリシーに規定されたとおりの目的及び利用を除き、秘密かつ安全に保護され、「Need-to-Know」の原則に従ってのみ開示されます。

7.3      当社は、あなたの個人データをデータ処理者に対して外注及び委託する場合、当該データ処理者の本プライバシーポリシーの遵守を精査するために契約及びその他の手段を利用します。

 

7.4      当社は、あなたが提供する個人データを保護するために業界標準に沿った組織的で、物理的及び技術的なセキュリティ対策を採用しました。当社のセキュリティ対策には、SSL証明書への署名、TLS暗号化及びハッシュ化されたパスワードの保存が含まれます。

 

7.5      あなたは、あなたの本アプリケーションのパスワードを秘密に保持することに責任を負っています。あなたは、あなたの本アプリケーションのパスワードをいかなる第三者に対しても開示又は別途公開してはなりません。あなたは、あなたのパスワード又は記録が危殆化されたと信じる場合、当社に直ちにお知らせください。

 

7.6      インターネットを経由する情報の移転は、完全に安全ではありません。当社は、あなたの個人データを保護するためにセキュリティ対策を講じていますが、本アプリケーションに送信されたあなたの個人データのセキュリティを保証できないので、送信はあなた自身の自己責任になります。

 

8.         個人データの保持

8.1      あなたから収集された個人データは、適用される法令により別途要請又は許容される場合を除き、本プライバシーポリシーの第4条に記載する目的を遂行するために必要な期間を超えて保持されません。

 

8.2      当社の本アプリケーションに登録されたあなたのアカウント が3年を超える期間アクセスされなかった場合、又は当社があなたのアカウントをあなたの要求に基づき閉鎖した場合（以下その時点を「終了日」といいます。）、あなたの個人データは、当社により本プライバシーポリシーの第4条に記載する目的上必要な間、又は適用される法令により許容される間、保持されます。当社の契約上又は法令上の義務を遵守するために必要がある場合、又はあなたが個人データの当社による継続した保持に承諾した場合、当社は、これより長い期間あなたの個人データを保持することができます。

 

8.3      保持期間の終了時に、あなたの個人データ、全てのアプリ関連のデータ及びアカウントに関連する情報が削除されることを、当社は確保します。あなたの個人データが含まれる物理的な書面については、当該書面は、シュレッダーにかけるか、又は当該書面の秘密かつ安全な破棄を確保する別の方法で破棄されます。

 

8.4      当社は、当社のデータ処理者のみが、本プライバシーポリシーの第4条に記載する目的を達成するのに必要な期間のみ、あなたの個人データを保持することを確保します。個人データが本プライバシーポリシーの第4条に記載する目的上必要でなくなった場合、当社のデータ処理者は、適用される法令に基づき削除が禁止される場合を除き、保持されている個人データを削除します。

 

9.         あなたの権利

9.1      当社は、あなたの個人データに対するあなたの法令上の権利を尊重します。当社は、あなたの法令上の権利及び当社がその権利を保護するために講じる措置を以下に列挙します。全てのデータ保護法令は同じではないため、この全ての権利は全ての国では適用されません。

 

(A)       あなたの個人データの処理に関する情報を取得し、当社があなたについて保持する個人データにアクセスする権利

(B)       あなたの個人データが不正確又は不完全である場合、当社があなたの個人データを修正することを要求する権利

1.1      This Privacy Policy explains how Lalamove along with its affiliates (referred to as “we”, “our”, “us” and “Lalamove”) collect, hold, process, transfer and use your personal data and what corresponding rights you have in relation to the processing of personal data. For the purpose of this Privacy Policy, Lalamove means the particular entity providing Services for you on the date you receive this Privacy Policy. (Please see the list of all Lalamove entities in APPENDIX 2).

 

1.2      This Privacy Policy concerns the following personal data that we collect about you when you use or access our web applications, mobile applications (jointly referred to as “Applications”) and our website at https://www.lalamove.com/ja-jp/.

 

1.3      We operate Applications and website to act as a platform to connect users of our platform to drivers, including individuals using other modes of transportation, and to help facilitate such drivers to provide on-demand delivery services and purchasing services (“Services”). Our Applications and Services are primarily designed for adults. We will not knowingly collect any personal data from minors (i.e. persons who have not attained the age of 18 years, or equivalent minimum age for full legal capacity in relevant jurisdiction) unless such data has been provided with prior consent from a relevant person (i.e. a person who has parental responsibility for the minor). In the event that you as the relevant person disclose such personal data of a minor under your parental responsibility to us, you hereby consent to the collection and processing of such minor’s personal data and accept and agree to be bound by this Privacy Policy. If we are informed of any collection of personal data from a minor without the consent of a person with parental responsibility over such minor, we will delete such personal data.

 

1.4      This Privacy Policy applies to personal data of (jointly referred as “you” or “your”):

2.         Sources of personal data

2.1      When you visit our website, access or use our Applications and Services, we are likely to ask you to provide your personal data. If you do not provide the relevant data, we may not be able to provide you with our products or services or respond to any queries you may have. For example, you may not be able to request delivery services through our website or Applications.

 

2.2      We will collect and process the personal data:

(A)       provided by you directly to us, such as during account creation through our Applications, your entry into our competitions, contests and promotional activities, subscribing to our blog or updates, or sending us correspondence through our website, Applications or by phone;

(B)       generated during your use of our website, Services and Applications. For example, we may collect your IP address and device information when you visit our website.

(C)      we obtained from third parties (such as third party agents, other Users, our service providers and business partners). For example, our third party agents  may provide us with additional verification and background information of Drivers, other Users may provide us with your name and phone number when booking a vehicle for you.

 

2.3      We may also collect personal data through software development kits (“SDKs”) used in providing the Services.

 

2.4      We may also collect personal data from Drivers who participate in our Driver Referral Program and Driver Campaign (“Drivers’ Programs”) to the extent relevant in processing Drivers’ request to enter or participate in the Drivers’ Programs.

3.1      The personal data collected by us about you will include the following data:

(A)       from Visitors:

(1)    IP address or other unique device identifiers; and

(2)    usage of our website or the Applications.

(12) information required to collect and pay any fees;

(13) vehicle information and picture;

(14) vehicle insurance information;

(15) national identification number and expiry date; and

(16) date of birth.

 

3.2      We only collect personal data that we reasonably need for use in connection with the purposes stated in paragraph ‎4 of this Privacy Policy. We do not collect personal data that is unnecessary or excessive.

4.1      We may collect, process, compile and collate your personal data in the form of:

(6)    records of your deliveries and performance; and

(7)    records of your vehicles, driving permit, vehicle insurance and vehicle license.

4.3      If we want to use your personal data for other purposes not covered by this Privacy Policy, we will notify you and obtain your prior consent where applicable, and ensure that the use of your personal data complies with the applicable laws.

 

4.4      We are allowed to use your personal data in these ways because of one or more of the following apply:

(A)       we have obtained your consent;

(B)       we need to do so in order to perform our contractual obligations with you;

(C)      we have legal duties and regulatory obligations that we have to discharge;

(D)      the use of your personal data as described is necessary for our legitimate interests;

(E)       we need to do so in order to response to public health incidents or to protect the vital interests of nature persons; or

(F)       we have other legal bases allowed by applicable laws to process your personal data.

(A)       sharing Users’ or Agents’ full name, phone number, personal data contained in free text box voluntarily entered by a User, and pick up or drop off locations with Drivers after a delivery has been initiated for the purposes of completing a delivery;

(B)       sharing the Driver’s name, phone number, driver profile information, vehicle information, vehicle picture and geolocation with Users or Agents after a delivery has been initiated for the purposes of completing a delivery; and if you are a member of a fleet, your personal data (e.g. name, phone number, driver profile information, records and reports of usage of our Services and Applications, records of payment, vehicle information) will be shared with the owner or manager of the fleet.

You should take care when disclosing your personal data to Drivers, or to Users or Agents. You understand and acknowledge that we cannot control the actions of other users with whom you may choose to share the personal data with. We do not monitor the use of such features in the normal course of business although we reserve the right to do so at our discretion. Therefore, you understand and acknowledge that we cannot and do not guarantee that the personal data you share with other users will not be reviewed by unauthorised persons. You also acknowledge that your personal data may still be accessed by the relevant users with whom you shared the personal data with after the delivery is completed. For example, the relevant user may view the transaction records which contains your personal data.

 

5.2      We may also share your personal data to provide our website, Services, Applications or for legal reasons with:

(A)       our employees, officers or independent consultants;

(B)       our auditors and external legal and financial advisors;

(C)      our suppliers, business partners, data processors and sub-contractors including:

(H)   another company with connection in or during negotiations of any merger, sale of company assets, consolidation or restructuring, financing or acquisition of all or a portion of our business by or into that other company.

 

5.3      We will ensure third parties are under confidentiality obligations before we share your personal data with the third parties set out in paragraph ‎5.2 of this Privacy Policy.

7.1      Once we receive your personal data, we will use all reasonably practicable steps and security measures as required under the applicable laws, to ensure that your personal data is stored securely and protected by us and our data processors against unauthorised or accidental access, processing, erasure, loss or use.

JAPAN

We and the Group companies may jointly use your Personal Data handled by Group companies within the Group. With regard to the information described in section 3, Personal Data will be shared with companies in Appendix 2 if necessary to achieve the purposes below.
